Yes the court found that the scratch likely could not be criminal damage, but this was a quirk of how the charge was worded. It is extremely notable that dismantling the barrier would have been criminal damage despite no harm to any part of the structure, had the charge been for criminal damage to the barrier as a structure rather than part of the barrier.
