Hello everyone…

We just finished our 4-week End-of-Life seminar series, created and spearheaded by our own Rick Hahn, in conjunction with Payap Lifelong Learning. Our thanks to everyone, and particularly to Joe Lynch from Lanna Lawyers, and Heather Smith from McKean Senior Center, who gave us the benefit of their knowledge and years of experience to help us understand the many obstacles that expats face when dealing with such issues, as well as giving us great insight on how to overcome many of them. The fact the auditorium was packed all 4 weeks is a testament to both the need for such a program and the quality of the program itself. Congrats to everyone involved…great job!

On a totally different note, the smoky season is already upon us. Hopefully it won’t be as extreme as last year, which was due mostly to the fact the rain that clears it out now and then seldom came. Already this year the mountains to the west of town are nearly obscured, and the forecast shows nothing but sun. I’m trying to be optimistic, hoping the rains will come.

I’d like to remind everyone that we will have a General Meeting on March 23, but we don’t have one in April. That’s because so many members leave town for a while to escape the smoke. I’m not one of them, I just break out my 2.5 masks and endure it. I figure there’s something you have to put up with no matter where you live, and here it’s the smoke. To me, it’s an easy choice compared to tornadoes, earthquakes, hurricanes/typhoons, snow and ice, etc. The only real drawback is that I use the mountains to orient myself. Chiang Mai was largely built back in a time when the concept of streets making any sense at all wasn’t a consideration, so wandering through the endless neighborhoods and villages with their crazy streets, without any point of reference, can be disorienting on a good day. It’s downright confusing when you can’t see those mountains.

Speaking of March 23rd, I‘ll get into more detail later, but our speakers for the GM should be of great interest. Just a couple weeks after the meeting will be the world’s most unique and outrageously fun festival, Songkran, and we will learn about the traditions of the many celebrations held in Thailand and Chiang Mai, and about Songkran in particular. Our other featured speaker will educate us on the serious issue of human trafficking of children in this part of the world, and what we can do to fight it. As you may have figured out, I’m a sucker for anything that helps kids, so I’m anxious to learn how I can help.

Four of my friends and I decided that we would attend the February's breakfast buffet at Dukes. Since we all are retired, and keep very busy, it can sometimes mean that we make our decisions a bit late, as was with February's breakfast. When I went to sign us up, I saw the message "sorry, we are sold out." Then I read this in the next CEC newsletter: we [CEC] had an unusually high number of no-shows [19%] at the breakfast earlier this month." which meant that the five of us could have attended, but because people signed up, but never showed up, left us missing out on a wonderful breakfast buffet at Dukes. So, I am posting this to ask that you please contact the CEC as early as possible and inform them you can't make it, so you don't exclude others from attending. Thank you in advance for your understanding.

If for any reason you can't attend, you need only send an email to info@chiangmaiexpatsclub.com and we can have a full house and allow everyone to attend. It the decent and polite thing to do.

The Joint venture between LLL Payap and our own CEC on the End-of-Life program concluded today. This was in our opinion the CEC's best event ever.

Real Life Legal Anecdote*

Expat Life In Thailand - Keep your wits (and good manners) about you!
John, a foreigner living in Thailand for many years was an equal partner in a Guesthouse and Bar in Chiangmai with a long-term Thai friend. After several years John, the investor, became unhappy with how the business was being run as well as the need for him to be there constantly.

A meeting was held between John and his business partner and the manager. The meeting became “heated” with the outcome being John refused to invest more money to keep the business going unless changes were agreed. After the meeting nothing changed and John remained heavily involved.
Around six weeks later John was arrested and initially detained by Police overnight. Next morning Immigration Police picked John up from the Police station and transferred him, still under arrest, to Immigration Detention in Bangkok, from where he would be deported. His lawyers and his wife were unable to help.

After eleven months detention, loads of legal work and negotiations our staff were able to secure bail for John while he fights his business dispute case in the Chiangmai Courts. This matter is ongoing as at today.

OUR RECOMMENDATIONS.
1. Be very careful not to upset or abuse Thai partners or any individuals, especially with verbal or written abuse which can become defamation in Thailand. A criminal offence. NOTE: It is possible for anyone to lodge defamation charges against any other person under Thai law, by accusation alone!.

1. Be aware that if you are arrested your VISA is automatically VOID, and you will be turned over to Immigration for deportation.
2. Undoing the situation is almost impossible once you are detained by Immigration. Once deported you will be blacklisted from re-entering Thailand again for between 5 years to 99 years at Immigrations discretion. The is no court of appeal for Immigration charges.
3. Obtaining bail from Immigration Detention is virtually impossible. Only very limited circumstances are approved. Perhaps one case in one thousand.
