STATEMENT TO THE COURT
Honorable Andrea Bryan:

We the undersigned Vietnamese Americans in Santa Clara County, in the Bay Area, in the USA and around the world, including from Vietnam would like you to take into consideration the following when sentencing Mr. Ly Tong.

We understand that the jurors rendered him a verdict of violating Penal Code Sections 242, 146a, etc.

But we believe that Mr. Ly Tong was not intending on violating the law nor was he trying to hurt Dam Vinh Hung physically.

We came from a culture where except for the war there was little public violence and conflicts were resolved without prosecuting the disputing parties to every single letter of the law.

There are some who did not know that in California spraying a mixture of fish sauce and perfume constitutes an assault and that entering a building for such a purpose constitutes second degree burglary. Nevertheless, we acknowledge the verdict of the jurors.

The singer Dam Vinh Hung was no ordinary victim.

While coming to the U.S. many times to perform for financial gains, this self-proclaimed member of the Vietnamese Communist Party extols its virtue and serves as its propaganda.

The party of which Dam Vinh Hung is a proud member has oppressed the entire population for political and financial gains. Children of the self-appointed representatives of the “proletariat” flaunt their million-dollar cars and have bought real properties around the world that worth millions of dollars with money that the party has robbed from the people.

The party had sent hundreds of thousands former government civilians and religious leaders to hard labor concentration camps in attempts to suppress any prospective voice of dissent and to force them to live by the communist ideology. The party has murdered many others who peacefully disagreed with it. In California there are Vietnamese refugees who had been held from several months to twenty one years in hard labor concentration camps without charges and without trial.

There was the case of the late then-Catholic-Archbishop Nguyen Van Thuan who was held in isolation for more than seventeen years. Like many others he waspunished for his status, a Catholic religious leader, and not for any thing he did. The late Most Venerable Buddhist Thich Huyen Quang was house arrested for more than ten years.The Most Venerable Buddhist Thich Quang Do similarly was house arrested for more than twenty years. Both Buddhist monks did nothing other than being religious leaders.

In addition to these former detainees, many in the Vietnamese American community in one way or the other were victims of the Vietnamese Communist Party. Their properties were summarily taken away and their relatives were blacklisted from school and from government work. Tens of thousands of Vietnamese perished at sea while trying to escape the Communist
regime.

Against this backdrop, Mr. Tong’s intention was to embarrass the singer-communist and to expose his role as the party’s propaganda. Mr. Tong’s offense was no garden variety criminal behavior. He has dedicated his life after escaping Vietnam to demonstrate and to speak out against Communist tyranny and oppression. His action, though coming within the scope of the Penal Code, for intention and purposes was politically symbolic.

Mr. Ly Tong tried to give voice to countless past and present victims of the Communist Party.

The Vietnamese American community of the San Francisco Bay Area stands together with Mr. Ly Tong.

Kính thưa Đồng Bào Hải Ngoại,

Đến hôm nay, Chiến Sĩ Lý Tống đã tuyệt thực, tuyệt ẫm hơn 10 ngày rồi (LT tuyệt thực tuyệt ẫm kể từ 25/5/2012).

Nhưng Lý Tống tinh thần còn sáng suốt, còn ngồi nói chuyện với phái đoàn đến thăm ngày hôm nay. Phái Đoàn do Ông Dave Cortese, Giám Sát Quận Hạt Santa Clara, và Nguyễn Thế Vũ hướng dẫn, có hai Thành Viên Cộng Đồng đi cùng.

Để tích cực yễm trợ Chiến Sĩ Lý Tống, chiến hữu đã có quyết tâm thực hiện cho bằng được, ngăn chận “Xú Hoá Vận/VC” thi hành nghị quyết 36/VC, bước đầu của mưu đồ khống chế người Việt hải ngoại, trong tương lai.

Thành quả việc làm nhỏ, nhưng có tác dụng cao và lâu dài.

Đã hơn 2 năm qua, “xú công” của “xú hoá vận/VC” đã bị ngăn chận, khắp nơi trên thế giới.. Sau chiến công ngoạn mục, Chiến Sĩ LT thân yêu của chúng ta phải bị vướng vào vòng lao lý.

Người Việt Quốc Gia, không thể vô cảm, làm ngơ.

Chúng tôi khẩn thiết mời gọi NGƯỜI VIỆT HẢI NGOẠI tích cực ký THỈNH NGUYỆN THƯ ngay, để cho bà Chánh Án Andrea Y. Bryan hiểu:

@ Lý Tống hành động như thế là hoạt động đấu tranh chính trị, có mục đích cao cả là chẳng những độc lập, tự do, dân chủ cho VN, mà còn cho Cuba, cho tất cả các nước trên thế giới.

@Bà cũng hiễu thêm rằng đa số cộng đồng người Việt sát cánh với Lý Tống trong việc đấu tranh chính trị, việc nhỏ, nhưng hiệu quả cao và lâu dài…dứt khoát đây không phải là lãnh vực đơn giản dân sự hay hình sự thông thường trong xã hội.
Bà Chánh Án hiểu được như thế, chúng ta đặt hy vọng bà sẽ có Phán Quyết bảo vệ công bằng ,công lý cho Chiến Sĩ Lý Tống và Cộng Đồng Người Việt sẽ được dịp chào đón Người Chiến Sĩ đấu tranh chống cộng chiến thắng VC và chiến thắng cho Chính Nghĩa, nơi Pháp đình Hoa Kỳ.
